ALEXANDRIA, Va. – January 11, 2022 – Buchanan Ingersoll & Rooney intellectual property attorneys obtained a favorable decision from the U.S. Patent and Trademark Office Patent and Appeal Board (PTAB) on behalf of Hamilton Technologies LLC in an inter partes review patent challenge regarding life-saving mechanical ventilation systems.  In its final written decision issued on December 28, 2021, the PTAB held that all patent claims of the Tehrani US ‘571 Patent challenged by Hamilton Technologies LLC are “unpatentable.”

The case, Hamilton Technologies LLC v. Fleur Tehrani, P.T.A.B., No. IPR2020-01199, 12/28/21, stems from a claim by Dr. Fleur Tehrani, an electrical engineering professor, that Hamilton’s Intellivent-ASV ventilator control systems infringe certain claims of Tehrani’s ‘571 patent. The PTAB decision clears the way for Hamilton Technologies LLC to proceed with pending FDA approval of its ventilator systems for entry into the U.S. market.

Additionally, on December 22, 2021 the Intellectual Property Enterprise Court (IPEC) in the United Kingdom, delivered its decision in a companion case, number IP-2019-000196: Tehrani v Hamilton Bonaduz AG (Hamilton), finding for Hamilton in a patent infringement lawsuit brought by Tehrani.
